General Terms and Conditions (GTC) of Albert Drescher – Photography
1. Scope
(1) These General Terms and Conditions (GTC) apply to all contracts between Albert Drescher, Platzstraße 2, 88348 Bad Saulgau (hereinafter referred to as “Photographer”) and his customers (hereinafter referred to as “Customer”), unless expressly agreed otherwise.
(2) Any deviating terms and conditions of the customer shall only apply if the photographer expressly agrees to them in writing.
2. Conclusion of contract
(1) Offers made by the photographer are subject to change and non-binding.
(2) A contract is concluded when the customer accepts the photographer’s offer in writing or verbally or when a booking is confirmed.
3. Services of the photographer
(1) The photographer provides photography services, including but not limited to weddings, portrait photography, event photography and product photography.
(2) The nature and scope of the service shall be determined by the individual agreement between the photographer and the customer.
(3) The photographer reserves the right to exercise artistic freedom in image design and processing.
4. Remuneration and payment terms
(1) The agreed prices are based on the photographer’s offer or price list.
(2) A deposit may be required upon agreement. The remaining amount is due upon delivery of the paintings at the latest.
(3) Payments can be made by bank transfer or in cash.
(4) If the customer defaults on payment, the photographer reserves the right to charge default interest in accordance with statutory provisions.
5. Copyright and rights of use
(1) The photographer remains the author of all images in accordance with Section 7 of the Copyright Act.
(2) Unless otherwise agreed, the customer shall receive a simple right of use for private purposes.
(3) Commercial use or transfer to third parties is only permitted with the written consent of the photographer.
(4) The photographer may use the images for his own advertising purposes (e.g. website, social media) unless the customer expressly objects.
6. Cancellation and rescheduling
(1) Cancellation by the customer is free of charge up to 7 days before the agreed appointment. After that, a cancellation fee of up to 50% of the agreed fee may be charged.
(2) In case of unforeseeable events (e.g. illness, weather conditions) the appointment may be postponed in consultation with the photographer.
7. Liability
(1) The photographer is only liable for damages caused intentionally or through gross negligence.
(2) The photographer assumes no liability for technical failures, force majeure or unforeseeable events.
(3) The customer is obliged to check the pictures for defects after delivery.
8. Data protection
(1) The photographer processes personal data exclusively for the purpose of fulfilling the contract and in compliance with data protection laws.

9. Final provisions
(1) The law of the Federal Republic of Germany shall apply.
(2) The place of jurisdiction shall be, to the extent permitted by law, the photographer’s registered office in Bad Saulgau.
(3) Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
